2. The information we collect

Depending on your relationship with us (for example, a property owner, client, prospective client, contractor or supplier), we may collect and process:

Your name, postal address, email address and telephone number
Details of the property or properties we factor for you, and your ownership share
Correspondence and records of our communications with you
Account and financial information — invoices, statements, balances and payment records
Payment and bank details necessary to collect or refund sums due, including information obtained through regulated Open Banking connections to our own business bank accounts for reconciliation
Information relating to maintenance, repairs, inspections and insurance for your property

3. How and why we use your information

We use your personal data to provide our property factoring services and to run our business. Our lawful bases under the UK GDPR are:

Contract — to deliver the factoring services set out in our written statement of services, administer your account, arrange maintenance and insurance, and process payments
Legal obligation — to meet our duties under the Property Factors (Scotland) Act 2011, accounting and tax law, and anti-money-laundering requirements
Legitimate interests — to manage and improve our services, keep accurate records, recover sums due, and prevent fraud, in a way that does not override your rights
Consent — where we ask for it, for example certain optional communications; you may withdraw consent at any time

4. Who we share your information with

We do not sell your personal data. We share it only where necessary to provide our services or to meet a legal obligation, including with:

Contractors and tradespeople instructed to carry out works at your property
Insurance brokers and insurers, where a communal policy is arranged
Our banks, payment processors and regulated Open Banking providers (such as Plaid) used to process and reconcile payments
Professional advisers such as accountants and solicitors
Regulators, courts and public authorities where we are legally required to do so

Where a supplier processes data on our behalf, we require them to protect it and to use it only for the purposes we specify.

5. How long we keep it

We keep personal data only for as long as necessary for the purposes described above, and to meet our legal, accounting and regulatory obligations. When it is no longer needed, we securely delete or dispose of it. Our retention periods are reviewed periodically.

6. How we protect your information

We maintain appropriate technical and organisational measures to keep your data secure, including access controls and multi-factor authentication, encryption of data in transit and at rest, up-to-date anti-malware protection, frequent backups with an off-site copy, and a documented information security policy. Connections to banking and Open Banking services use secure, regulated channels.

Ask us to erase your data, where there is no legal reason for us to keep it
Restrict or object to our processing in certain circumstances
